In the United States, after tariffs imposed during President Donald Trump’s tenure were declared illegal, the refund process has now begun. American companies can apply through a new online portal starting Monday. This is being considered the largest tariff refund in US history, with $166 billion (around ₹13.8 lakh crore) set to be returned. The decision to issue refunds came after a Supreme Court order. The court said that the Trump administration had misused emergency powers to impose tariffs. Following this, the Court of International Trade directed that importers be refunded their deposits along with interest. Under this ruling, around 330,000 importers will receive relief. They had paid heavy taxes last year on goods ranging from car parts to smartphones. Applications to be processed through CAPE portal The US Customs and Border Protection (CBP) has launched a new portal called CAPE (Consolidated Administration and Processing of Entries). It is part of the ACE (Automated Commercial Environment) system. Through this, importers will be able to submit “CAPE declarations” and file their claims, with the aim of making the process faster and simpler. Refund within 60–90 days To receive a refund, “Importer of Record” and authorised customs brokers must register on the ACE portal and provide bank account details. According to CBP, payments can be processed within 60–90 days for applications with complete and accurate information. However, delays may occur if documents are incomplete or further verification is required. Limited relief in the first phase CBP has clarified that not all importers will receive refunds in the first phase. Currently, only “unliquidated entries” (where tax assessment is not yet finalised) and entries within 80 days are included. Other cases will be taken up in later phases. 56,000 importers registered Court records show that around 330,000 importers had collectively paid $166 billion in tariffs. By April 9, only about 56,500 importers had registered in the electronic payment system, which is mandatory to receive refunds. How much benefit for consumers? According to the New York Federal Reserve Bank, about 90% of the tariff burden was shared between companies and consumers. Some firms, especially in logistics and retail, have indicated possible relief for customers, but it is still unclear how much benefit will actually reach ordinary consumers. Legal battle continues The dispute over tariffs is not over yet. Companies like Costco had already filed lawsuits against the tariffs. The trade court has indicated that several cases may be combined for hearings. The government may also appeal the decision, which could further prolong the process. Questions raised over 10% global tariff Meanwhile, judges at the Court of International Trade have also questioned the legality of the 10% global tariff imposed by Trump. Petitions have been filed by 24 states (mostly Democrat-led) and small businesses. The court has asked whether a trade deficit alone is sufficient justification for such a major step.
