The duo was initially remanded to five days custody on October 14 by Special Executive Magistrate Mahesh Kumar Meena after police alleged they had violated their one-year peace bonds and issued social media calls to mobilise fresh protests at the site, posing a threat to public order and tranquillity under Section 130 of the BNSS. While the police opposed their release citing apprehension of further unrest, Advocate Abhik Chimni appearing for the two leaders argued for bail, contending that the act of hoisting the national flag cannot be construed as a breach of peace.
