The Lucknow bench of the Allahabad High Court has ordered the registration of an FIR against Congress leader Rahul Gandhi. The hearing in the case related to dual citizenship was held on Friday. The matter challenges a lower court decision that had rejected the plea seeking an FIR against Rahul Gandhi.

First detailed hearing at High Court level This is the first time the matter is being heard in detail at this level before the Lucknow bench, with the Union Home Ministry officially presenting its stand. The petitioner has claimed that the affidavit filed could prove crucial in supporting the allegations. However, detailed arguments on the contents of the affidavit are likely in the next hearing. Petitioner Vignesh Shishir has claimed that he has presented key evidence before the court. Court seeks ‘top secret’ files, directs ministry During the hearing, Justice Subhash Vidyarthi directed the Foreigners Division of the Home Ministry to produce all necessary documents related to the case, including confidential files, at the next hearing. Petitioner claims evidence of voting in UK Vignesh Shishir, who filed the petition, claimed that he has submitted documents and evidence indicating that Rahul Gandhi was a voter in the United Kingdom, with records of participation in elections there. However, the authenticity of these claims will be decided by the court. Challenge to lower court order seeking FIR The petition has been filed as a criminal application challenging the January 28, 2026, order of the Special MP-MLA magistrate, which had refused to direct the Kotwali police station in Rae Bareli to register an FIR. This decision has now been challenged in the High Court. Demand for FIR under multiple serious charges The petition seeks registration of an FIR against Rahul Gandhi under various sections of the Bharatiya Nyaya Sanhita (BNS) 2023, along with the Official Secrets Act 1923, Passport Act 1967, and Foreigners Act 1946. The petitioner argues that the matter involves serious issues related to national security and citizenship. ​
