On the 7th day of the encounter of Bharat Bhushan Tiwari from Bhojpur, a major action has been taken. Based on an application by Bharat’s mother, an FIR for murder has been filed against the SDPO, SHO and other police personnel. Bharat Tiwari’s mother had accused Jagdishpur SDPO Rajesh Kumar Sharma and then Station House Officer Rajesh Kumar Malakar along with other police personnel of shooting and killing him after he surrendered. On June 17, Bhojpur police had shot Bharat when he had come on Facebook Live and surrendered. This is the fourth FIR in this case so far. Till now, the Samrat Sarkar had been avoiding filing an FIR for murder against the police personnel. Dainik Bhaskar had continuously exposed the theory given by the police in the Bharat encounter and the responsible police personnel. The impact of this is that now an FIR for murder has been filed. Now know, what all has been written in the application given by Bharat Tiwari’s mother Asha Devi? In the Bharat Tiwari encounter case, an application was submitted on June 18 by his mother Asha Devi to Bhojpur SP Raj to register an FIR against some policemen involved in the encounter. In the application given to SP Raj, Asha Devi had written that on June 17 at 8 AM, a team led by Jagdishpur SDPO, along with the Shahpur police station in-charge and other policemen, came to my house. The team told Bharat Tiwari to come with them to where the flood-displaced people of Jawainiya village are staying and tell them what problems those people have and what their demands are. In the application, Asha Devi had also said that upon reaching the flood-affected people of Jawainiya village, he went live on Facebook and after stating their demands, threw his weapon on the ground and surrendered himself. After this, the policemen surrounded my son. Then on the orders of Jagdishpur SDPO, the policemen shot Bharat 5 times and injured him. After this, they took Bharat away. After the incident, my husband and Bharat’s father Kashinath Tiwari were kept locked in Shahpur police station all day. In the evening, we were informed that your son has died. An FIR should be registered and legal action taken against Jagdishpur SDPO Rajesh Kumar Sharma, Shahpur police station SHO and other assisting police personnel involved in the encounter, so that my son can get justice. How the government went on the backfoot after Bhaskar’s report The encounter took place on June 17. Police claimed that Bharat fired 10-12 rounds. He was killed in retaliatory action. On June 18, Bhaskar Digital raised questions about the encounter and exposed the irresponsible faces responsible.

After both Bhaskar’s reports, on June 20, Chief Minister Samrat Chaudhary ordered a judicial inquiry and suspended 4 police personnel. After this, Bhaskar Digital published an eyewitness report of the incident. On the morning of June 23, Bhaskar Digital also exposed the false theory of the police’s first FIR. It also reported the status of the mother’s application that the police had not filed an FIR till then. After this report, by the afternoon of June 23, the government had an FIR for murder registered against the police personnel. First FIR (June 17) In the first FIR, along with Bharat Bhushan Tiwari, his father Kashinath Tiwari and brother Chandan Tiwari were also made accused. This case was registered on the statement of the then Station House Officer Rajesh Malakar, while the responsibility of investigating it was assigned to ASI Babita Devi. According to the FIR, under case number 759/26, the police team reached his house in Bilauti village around 4:40 AM on the morning of June 16 to arrest Bharat Tiwari. The police claim that when the door was opened at approximately 5:10 AM, Bharat Tiwari became aggressive upon seeing the police and pointed a pistol at them. After this, the police closed the door. It is alleged that Bharat climbed onto the roof of the house and started firing at the police team from there, following which the policemen took safe positions and defended themselves. The FIR also states that during questioning, Bharat’s father and brother concealed information about him having weapons from the police. After this, the police team strengthened the cordon of the area and returned to the station for further strategy. Second FIR (June 17) Second FIR in the Bharat Tiwari encounter case was registered on June 17 at 12:20 pm based on the statement of then station house officer Rajesh Malakar. In the FIR, Bharat Bhushan Tiwari has been named as an accused, stating that he died during treatment at PMCH after being injured in the encounter. The investigation has been assigned to Inspector Santosh Kumar. According to the FIR, police and STF teams had gone to Biloti village for a follow-up raid when Tiwari was allegedly seen brandishing a weapon and running towards the fields. Near the Chher river, on a kutcha road, police asked him to surrender. However, he allegedly fired at the bonnet of a government vehicle. Police further stated that SHO Rajesh Malakar then fired a round in retaliation. Tiwari initially pretended to surrender but allegedly opened fire again, firing two rounds at the police team. The FIR adds that in self-defence, STF personnel Akshay Kumar fired four rounds from his service pistol below the waist, injuring Tiwari in the legs. He was taken to hospital in a critical condition, where he later died during treatment. During the spot inspection, the FSL team recovered a loaded 7.65 bore pistol, two live cartridges and two empty shells. Police claimed that Tiwari fired 10–12 rounds, while the police team fired a total of five rounds during the encounter. Third FIR in the Bharat Tiwari encounter case was registered on June 18 at 8:40 am on the statement of Sub-Inspector Sachchidanand Yadav. The case relates to the protest after Tiwari’s death, where the body was kept on the national highway and the road was blocked. Third FIR (June 18) In the FIR, 13 named accused including Saroj Tripathi, Mukhiya Baliram Yadav, Rakesh Yadav and Anjani Tiwari, along with 50 to 60 unidentified people, have been booked. The investigation has been handed over to ASI Babita Devi, and the action was taken on the orders of SI Md. Alimuddin Khan. According to the FIR, Bharat Tiwari died on June 17 night during treatment at PMCH. After the post-mortem, the body was handed over to the family. The next morning, on June 18, family members and villagers placed the body under a tent at Biloti Mor on NH-922 and blocked both lanes of traffic. Police said that when Sub-Inspector Sachchidanand Yadav reached the spot with force to pacify the crowd, the mob allegedly resorted to pushing, abuse and stone-pelting, forcing the police to retreat. The FIR adds that the highway remained blocked for nearly five hours, and traffic was restored only after intervention of senior officials and persuasion. Police also claimed that the entire incident was videographed. ​
