The double bench of Gwalior High Court upheld the transfer of a primary teacher, dismissing his appeal. The court clarified that transfer is a compulsion of service and no employee can claim to be posted permanently at a particular place. This case is related to Sheopur district. Mohammed Amin Khan was transferred on June 16, 2025, from Government Middle School Urdu, Gandhi, to another middle school. He challenged this order in the single bench, but his petition was dismissed. After this, he filed an appeal in the double bench. In the petition, Khan argued that on July 28, 2025, the SDO Registration Officer, Nagar Parishad Sheopur, had appointed him as a Booth Level Officer (BLO), and therefore his transfer could not be done. He also stated that his initial appointment was to the post of Shiksha Karmi Grade-III (Urdu), whereas Urdu subject is not taught in the new school. Double Bench also rejected the teacher’s arguments The Division Bench rejected these arguments. The Court stated that the appellant had served for 27 years at the current place of posting and 9 years as a primary teacher. The Court also found that he did not present any evidence to prove that the transfer was mala fide. The Bench clearly stated that after becoming a primary teacher, there is no compulsion to teach only Urdu. On these grounds, the High Court, upholding the order of the Single Bench, dismissed the appeal of Mohammad Amin Khan. ​
